The Health Insurance Portability and Accountability Act (HIPAA) received a set of teeth last in year and the compliance deadline for many of the provisions was February 2010. The Health Information Technology portion of the mammoth American Recovery & Reinvestment Act of 2009 (aka HITECH and ARRA respectively) added a number of new requirements, such as greater breach notification requirements, as well as stiffer penalties for non-compliance with HIPAA. The bill also expanded the range of companies that are required to comply, for example Business Associates (BA) must now comply with the HIPAA security rule and HITECH’s security provisions.
